1. Introduction

These Terms & Conditions (“Terms”) govern your access to and use of the Blurpe website, platform and related services.

Blurpe is operated by Blurpe Technologies Ltd, located at The Reserved Golf Estate, Port Harcourt, Nigeria.

Blurpe provides AI-powered recruitment services that help employers and recruitment agencies discover and assess talent, and help job seekers, candidates, freelancers and creators present their skills and professional experience.

Our services may include candidate search, profile management, CV and portfolio review, AI-assisted interviews, suitability reports, job listings and free or paid subscriptions.

By accessing or using Blurpe, you agree to these Terms. If you do not agree, do not use the platform.

If you use Blurpe on behalf of an organisation, you confirm that you are authorised to accept these Terms for that organisation.

These Terms should be read alongside our Privacy Policy and any additional terms presented for a specific feature or subscription.

2. Eligibility and Accounts

You may use Blurpe only if you have the legal capacity required to enter into a binding agreement under applicable law.

When creating or using an account, you agree to:

  • Provide accurate and up-to-date information.
  • Keep your account information reasonably current.
  • Protect your login credentials and account access.
  • Notify us promptly of suspected unauthorised access.
  • Use Blurpe lawfully and in accordance with these Terms.
  • Avoid impersonation, fraud or misleading representations.

You are responsible for activity conducted through your account, subject to applicable law and circumstances beyond your reasonable control.

We may request additional information where reasonably necessary to verify an account, address suspected misuse or comply with legal obligations.

3. User Types and Responsibilities

3.1 Employers

Employers may use Blurpe to search for talent, publish roles, review candidate profiles, use AI-assisted assessments and manage recruitment activities.

Employers agree to:

  • Provide accurate information about their organisation and job opportunities.
  • Use lawful, relevant and appropriate selection criteria.
  • Use candidate information only for authorised and legitimate purposes.
  • Restrict access to candidate information to authorised individuals.
  • Respect candidate privacy and applicable data protection laws.
  • Avoid fraudulent, discriminatory or misleading recruitment practices.
  • Independently review important information and AI-generated results before making hiring decisions.

Employers are responsible for their recruitment processes, hiring decisions, employment offers, working conditions and compliance with applicable employment and equality laws.

Blurpe does not guarantee that an employer will find a suitable candidate or that any candidate will accept an offer or perform to a particular standard.

3.2 Recruitment Agencies

Recruitment agencies may use Blurpe to discover, assess and manage candidates in connection with authorised recruitment activities.

Agencies must ensure they have the necessary authority and lawful basis to submit, disclose and process candidate information.

Agencies must not misrepresent job opportunities, client identities, employment conditions or the status of a recruitment process.

3.3 Job Seekers, Candidates, Freelancers and Creators

You may use Blurpe to create a professional profile, submit a CV or portfolio, participate in assessments and express interest in opportunities.

You agree to:

  • Provide information that is accurate to the best of your knowledge.
  • Have the right to submit any CV, portfolio, work sample or document you upload.
  • Avoid falsely claiming qualifications, experience, certifications or achievements.
  • Avoid submitting another person's personal information without appropriate authority.
  • Respect the confidentiality, privacy and intellectual property rights of others.
  • Use the platform and recruitment communications honestly and lawfully.

You are responsible for reviewing your profile and correcting inaccurate information where the platform allows you to do so.

Creating a profile does not guarantee matches, interviews, shortlisting, employment or freelance work.

4. Candidate Profiles and Job Listings

Blurpe enables employers and recruitment agencies to search for candidate profiles through its recruitment features.

By submitting professional information to Blurpe, you understand that relevant information may be made available to employers and recruitment agencies using the platform for recruitment purposes, subject to the platform's features, settings and applicable privacy notices.

Employers and agencies are responsible for using that information lawfully and appropriately.

Employers and agencies are responsible for the accuracy and legality of job listings, role descriptions, compensation details and recruitment materials they publish.

Job listings must not contain fraudulent opportunities, materially misleading claims, unlawful discriminatory requirements or content that infringes another person's rights.

Blurpe may remove, restrict or decline to display content that it reasonably believes breaches these Terms, violates applicable law or creates a risk to the platform or its users.

Unless expressly agreed otherwise in writing, Blurpe is a technology platform supporting recruitment activities. It is not the employer under a job listing, does not guarantee a job's availability and is not a party to an employment or freelance agreement entered into directly between users.

Users should independently verify material details of opportunities before making employment, financial or personal decisions.

5. AI Matching, Interviews and Suitability Reports

Blurpe uses AI to support recruitment workflows. Depending on the feature, this may include candidate matching, analysis of professional information, audio or video interviews, interview summaries and suitability reports.

5.1 Purpose of AI

Our AI features are intended to help users identify potentially relevant skills, experience and information in relation to role requirements.

AI outputs may include suggested matches, summaries, assessments or recommendations for further consideration.

5.2 AI limitations

AI-generated results may be inaccurate, incomplete or affected by limitations in the underlying information or technology.

A match, score, ranking, interview summary or suitability report is not a guarantee of a candidate's ability, character, future performance or suitability for a role.

Users must independently review relevant information before relying on AI outputs for consequential decisions.

5.3 Hiring decisions

Employers and recruitment agencies remain responsible for their hiring decisions and must comply with applicable employment, equality and data protection laws.

Blurpe's stated approach is to provide AI assistance while employers make the final hiring decisions. Where a particular feature's operation or use falls within legal requirements for automated decision-making, the relevant parties must comply with those requirements and any applicable safeguards.

These Terms do not authorise unlawful discrimination or remove any legal right a candidate may have concerning automated processing.

5.4 Interviews and recordings

Where an interview feature captures or processes audio or video, you must use the feature honestly and comply with the instructions and notices presented to you.

Do not record, share or disclose another person's interview or personal information without the necessary authority and legal basis.

The collection, processing and retention of interview information are explained in our Privacy Policy and any applicable feature-specific notice.

5.5 No guaranteed recruitment outcomes

Blurpe does not guarantee that its AI tools will identify every qualified candidate, produce error-free assessments, eliminate bias or deliver a particular hiring outcome.

Nothing in this section excludes obligations that cannot lawfully be excluded.

6. User Content and Intellectual Property

6.1 Your content

“User Content” means content you submit to or make available through Blurpe, including CVs, portfolios, work samples, job descriptions, messages, interview responses and assessment materials.

You retain ownership of User Content to the extent you own the relevant rights.

You grant Blurpe a limited, non-exclusive licence to host, store, reproduce, process, display and transmit your User Content as reasonably necessary to provide the services you request, operate and secure the platform, and carry out other uses disclosed in our Privacy Policy or otherwise authorised by law.

This licence continues for as long as reasonably necessary for those purposes, subject to applicable retention requirements and deletion obligations.

You confirm that you have the rights and authority necessary to submit your User Content and grant this licence.

6.2 Employer and agency content

Employers and agencies are responsible for ensuring that job descriptions, company materials, candidate information and other content they submit may lawfully be used on Blurpe.

They must have the necessary authority and legal basis to submit or disclose candidate information.

6.3 Blurpe's intellectual property

Subject to third-party rights and applicable law, Blurpe and its licensors retain their rights in the platform, software, branding, design, interfaces, documentation and underlying technology.

Except as expressly permitted by law or authorised by Blurpe, you must not:

  • Copy or redistribute substantial parts of the platform without permission.
  • Attempt to access source code or reverse engineer the service except where applicable law permits this.
  • Remove proprietary notices or misrepresent ownership of Blurpe's intellectual property.
  • Use Blurpe's name or branding to imply an unauthorised endorsement or affiliation.

These Terms do not transfer ownership of Blurpe's intellectual property to users.

6.4 AI processing and model training

Blurpe processes relevant User Content to provide its AI matching, interview and assessment features.

Blurpe's stated policy is not to use candidate data for additional AI-model training as a separate purpose. This does not prevent the processing needed to provide the requested AI service.

Third-party providers may process data under their own service terms and applicable agreements. Blurpe will assess the relevant provider practices and settings and disclose material additional uses as required by law.

Submitting User Content does not grant Blurpe unrestricted permission to use it for unrelated purposes or to commercialise it independently.

7. Acceptable Use

You must not use Blurpe to:

  • Engage in fraud, impersonation, phishing, harassment or unlawful discrimination.
  • Publish fake jobs or misleading candidate profiles.
  • Collect personal information through unauthorised scraping or harvesting.
  • Access accounts, systems or data without permission.
  • Upload malware or interfere with the platform's security or operation.
  • Circumvent access controls, subscription limits or security measures.
  • Send spam or use the platform for unauthorised bulk messaging.
  • Infringe intellectual property, privacy, confidentiality or other legal rights.
  • Manipulate AI assessments or matching results through deceptive conduct.
  • Use the platform in violation of applicable laws.
  • Misuse candidate information or confidential employer information.

We may investigate suspected violations and take proportionate action, including removing content, restricting functionality or suspending an account, subject to applicable law.

8. Free and Paid Subscriptions

Blurpe offers free and paid subscriptions. Features, access limits, prices and other plan conditions may vary.

8.1 Plan details and prices

The applicable features, price, billing frequency, usage limits and other material conditions will be displayed on the relevant pricing or checkout page before purchase.

Your subscription gives you access to the features specified for the selected plan, subject to these Terms and the applicable plan conditions.

8.2 Payment processing

Blurpe uses Paystack for payment processing. Your payment may also be subject to Paystack's applicable terms and policies.

You agree to pay the charges disclosed to you before completing a purchase. You should review the amount, currency, billing interval and any applicable taxes or additional charges before confirming payment.

8.3 Automatic renewal

Paid subscriptions may renew automatically on a monthly or annual basis, depending on the plan selected.

The applicable renewal interval, renewal price and cancellation method must be disclosed before purchase. By purchasing an automatically renewing plan, you authorise the applicable recurring charges in accordance with the terms disclosed at checkout and the payment method you have authorised.

You may cancel your subscription using the available account settings or the cancellation method stated in your subscription details. Cancellation will take effect according to the terms disclosed at purchase and applicable law.

8.4 Price and plan changes

Blurpe may change subscription prices or features from time to time.

Where a change affects an existing paid subscription, we will provide appropriate notice and obtain any additional consent required by law or the applicable subscription arrangement before charging a new amount.

8.5 Refunds

Refunds are available under the conditions applicable to the relevant subscription or purchase and subject to applicable law.

The specific eligibility criteria, request process, time limits and any exclusions must be stated in Blurpe's refund policy or disclosed before purchase.

Before paid subscriptions launch, Blurpe must publish or provide a complete refund policy and ensure that the applicable terms are clearly available at checkout. Nothing in these Terms removes a refund or other remedy that cannot lawfully be excluded.

8.6 Failed payments and access

If a payment fails, we may notify you, request updated payment information or restrict access to paid features where permitted by the disclosed subscription terms and applicable law.

Any suspension or cancellation for non-payment will be handled in accordance with those terms.

9. Third-Party Services

Blurpe relies on third-party services, including Supabase for database or related platform infrastructure, n8n for workflow automation and Paystack for payment processing.

The services may be governed by separate terms and privacy policies. Their availability, functionality and processing practices may change independently of Blurpe.

We may change or discontinue an integration where reasonably necessary, subject to applicable contractual obligations and user rights.

10. Confidentiality and Candidate Information

Users may access confidential information, including candidate records, recruitment plans, unpublished job opportunities and business information.

You agree to use confidential information only for authorised purposes and to take reasonable steps to prevent unauthorised access or disclosure.

Employers and recruitment agencies must protect candidate information and use it only for lawful, authorised recruitment activities.

Candidates and other users must not disclose confidential employer information or misuse information obtained through Blurpe.

These obligations do not prevent disclosures required by law or the use of information that is lawfully public or independently obtained without a confidentiality obligation.

11. Privacy and Data Protection

Our Privacy Policy explains how Blurpe collects and processes personal data.

You must not submit personal data that you have no lawful authority to disclose.

Where an employer or recruitment agency determines the purposes and means of processing candidate information, it remains responsible for its own obligations under applicable data protection law.

Blurpe's responsibilities depend on its role in the relevant processing activity and the applicable legal and contractual arrangements.

Where a separate data processing agreement is legally required, the relevant parties must put that agreement in place before the applicable processing begins.

12. Account Deletion, Suspension and Termination

You may stop using Blurpe at any time. You can delete your account through the account settings where that functionality is available.

Blurpe may restrict, suspend or terminate access where reasonably necessary to address a material breach of these Terms, suspected fraud, misuse, security risks, legal requirements or non-payment of applicable subscription charges.

Where appropriate and legally permitted, we will provide notice and an opportunity to address the issue before taking action.

Upon account deletion or termination, access to some or all features may cease. We will handle User Content and personal data in accordance with our Privacy Policy, applicable law and any relevant contractual commitments.

Some information may remain with employers or agencies to whom it was lawfully disclosed, or in records or backups retained for lawful purposes until deletion is required or reasonably practicable.

Provisions that by their nature should continue after termination, including applicable intellectual property, confidentiality and accrued payment obligations, will survive to the extent permitted by law.

13. Availability and Changes to Blurpe

We aim to provide a useful and reliable service but do not guarantee that Blurpe will always be available, uninterrupted or free from errors.

The platform may be temporarily unavailable due to maintenance, technical problems, security incidents, third-party outages or circumstances beyond our reasonable control.

We may modify, improve, replace or discontinue features as the product develops.

Where a material change affects a paid service or a user's contractual rights, we will address it in accordance with the applicable subscription terms and law.

14. Disclaimers

Blurpe provides tools to support recruitment and talent discovery. To the extent permitted by law, we do not guarantee:

  • That the platform will identify every suitable candidate or job opportunity.
  • That candidate profiles, CVs, portfolios or job listings are independently verified.
  • That AI-generated matches, summaries or assessments are accurate or complete.
  • That use of Blurpe will result in employment, hiring, revenue or another commercial outcome.
  • That third-party services will remain available without interruption.

Users remain responsible for verifying important information and making their own decisions.

Nothing in these Terms excludes a warranty, representation or statutory protection that applicable law does not permit us to exclude.

15. Limitation of Liability

To the extent permitted by applicable law, Blurpe will not be liable for indirect or consequential losses arising from use of the platform where such exclusion is legally enforceable.

Blurpe is not responsible for employment or hiring decisions made independently by employers or agencies, or for representations made by users that Blurpe has not expressly adopted or verified.

Any limitation of liability for direct losses must be applied only to the extent permitted by law. Nothing in these Terms excludes or limits liability for fraud, deliberate misconduct or other liability that cannot lawfully be excluded or limited.

This section does not remove any consumer rights or remedies that applicable law protects.

16. Indemnity

To the extent permitted by law, a user may be responsible for losses and reasonable costs arising directly from that user's unlawful conduct, material breach of these Terms or infringement of another person's rights.

This section does not require a user to indemnify Blurpe for losses caused by Blurpe's own unlawful conduct or for liabilities that cannot lawfully be transferred.

17. Governing Law and Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria, subject to mandatory legal protections or jurisdictional requirements that may apply to a particular user or transaction.

If a dispute arises, the parties should first attempt to resolve it through good-faith discussions.

If the dispute cannot be resolved informally, it may be referred to a court of competent jurisdiction in Nigeria, subject to applicable law and any mandatory rights of the parties.

Nothing in this section removes a right to bring a complaint before a competent regulatory authority where the law permits it.

18. Changes to These Terms

We may update these Terms to reflect changes in our services, subscriptions, business practices or legal obligations.

We will update the “Last updated” date when a revised version is published.

Where changes are material, we will provide notice through the platform, by email or by another reasonable method. Where applicable law requires affirmative acceptance, we will request it.

Continued use of Blurpe after updated Terms take effect constitutes acceptance only to the extent permitted by applicable law.

19. General Provisions

Entire agreement. These Terms, our Privacy Policy and any applicable subscription or feature-specific terms form the agreement governing your use of Blurpe, to the extent relevant to the service in question.

Severability. If a provision is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

No waiver. Failure to enforce a provision does not waive the right to enforce it later.

Assignment. You may not transfer your rights or obligations under these Terms where consent is required without obtaining that consent. Blurpe may transfer its rights and obligations as part of a lawful restructuring or business transaction, subject to applicable law and contractual obligations.

No employment or agency relationship. Unless expressly agreed in writing, these Terms do not create an employment, partnership, agency or joint venture relationship between Blurpe and a user.

Force majeure. Neither party will be responsible for delay or failure caused by circumstances beyond its reasonable control, to the extent permitted by law. This does not remove obligations that cannot lawfully be suspended.
